Please read these Terms of Service ("Terms") carefully before using Math Fury ("the App") operated by Alexander Klaas ("we," "our," or "us"). By downloading, installing, or using Math Fury, you agree to be bound by these Terms. If you do not agree, do not use the App.
Math Fury is an educational math game designed for children ages 5–10. The App is listed in the Apple App Store under the Kids Category. Because the intended users are children, these Terms are addressed to the parent or legal guardian who downloads, installs, or authorizes use of the App. By allowing a child to use Math Fury, you agree to these Terms on behalf of your child and yourself.
Subject to these Terms and the Apple Media Services Terms and Conditions, we grant you a limited, non-exclusive, non-transferable, revocable license to use Math Fury on Apple devices that you own or control, for personal, non-commercial use by you and the children in your care. This license does not allow you to:
Math Fury is an offline, single-player educational game that teaches arithmetic operations (addition, subtraction, multiplication, division, and more) through a synthwave cyber-retro visual style. The App includes 100 levels of progressive difficulty and does not require an internet connection.
Math Fury complies with Apple's Kids Category requirements:
Math Fury, including its design, code, features, artwork, music, sound effects, and branding, is owned by Alexander Klaas and protected by copyright, trademark, and other intellectual property laws.
Math Fury stores gameplay data (progress, statistics, achievements) locally on your device. This data is not transmitted to our servers. For details, see our Privacy Policy.
MATH FURY IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or perfectly accurate for any particular educational goal.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALEXANDER KLAAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF MATH FURY. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE PRICE YOU PAID FOR THE APP, OR $50 USD, WHICHEVER IS GREATER. NOTHING IN THESE TERMS LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY WHICH CANNOT BE LIMITED UNDER APPLICABLE LAW.
You acknowledge that these Terms are between you and Alexander Klaas only, and not with Apple Inc. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms.
You may terminate your use at any time by deleting the App. Upon deletion, all local data is removed from your device. We reserve the right to discontinue or modify Math Fury at any time without notice.
These Terms are governed by the laws of the Republic of Serbia. Any disputes arising from these Terms will be resolved in the courts of Belgrade, Serbia, unless applicable consumer protection law in your country of residence mandates a different forum. Consumer rights under the law of your country of residence are not affected.
We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top. Continued use of Math Fury after changes are posted constitutes acceptance of the updated Terms.
